Terms of Service

Turnpoint Consulting Approach

Terms of Service (Created April 1, 2017; last revised August 1, 2023)

If you (“User”) use the service (“Service”) provided by Turnpoint Consulting K.K. (“Company”), please be sure to read and agree to the following Terms of Use before using the Service.

Article 1 (Employment Placement Services)

The term “Career Consulting Services” as used herein shall mean career consulting services that introduce users to job openings that are considered to be a good match for the user's career, skills, aptitude, and future aspirations, as well as other related job search support services.

Article 2 (Application for and Use of the Service)

By using the service, the user is deemed to have accepted all of the terms and conditions of this agreement.

Article 3 (Reasons for Termination of Use of the Service)

We may terminate the provision of the
service without any notice to the user if we determine that the user has
(1) When the user has materially violated these Terms of Use
(2) When the relationship of trust between the user and the Company can no longer be maintained

Article 4 (Responsibilities of Users)

Users shall use the service of their own volition and shall bear all responsibility for their use of the service.
2. The user shall enter into an employment contract after confirming the working conditions directly with the company again at the user's own responsibility. The user agrees that the working conditions confirmed by the company and notified to the user are not the final guarantee of the employment contract.
3. If a dispute arises between the user and a third party due to the user's use of the service, the company will not take any responsibility, except in cases where the company is responsible, and the user will be responsible for dealing with the dispute on his/her own. Users shall deal with such disputes at their own responsibility and shall not cause any inconvenience to the Company.
4. Users recognize and accept that the Service may not always lead users to a successful job change.

Article 5 (Prohibition of Users)

Users shall not engage in any of the following acts on the Service.
(1)Registering or notifying false or inaccurate information.
(2)Defaming, threatening, coercing, or threatening to defame or slander a third party or the Company.
(3)Any act that infringes on the rights, including copyrights, trademarks, or other intellectual property rights, of a third party or the Company.
(4)Any act that infringes on the property, privacy, honor, or other rights of a third party or the Company.
(5)Any act that uses the Service to conduct sales activities or provide information for profit.
(6)Any act of reproduction, sale, publication, or any other use of information obtained through the Service beyond the scope of private use.
(7)Any act that interferes with the operation of the Service or damages the credibility of a third party or the Company, or any act that has the potential to do so.
(8)Actions that are or may be offensive to public order and morals.
(10)Actions that violate or may violate various laws and regulations.

Article 6 (Disclaimer)

By using this service, you agree that your job change is not guaranteed, and that if you have any dispute with a recruiter regarding working conditions or other contractual matters, you shall resolve it through consultation with the recruiter at your own expense and responsibility. In addition to the provisions of the statute of limitations, in the event that a registrant suffers damages as a result of using the service for reasons attributable to the Company, the Company shall be liable only for damages within the scope of normal occurrence as a direct result of such damages, and shall not be liable for any other damages. We shall not be liable for any other damages.

Article 7 (Non-warranty of information provided)

The information provided by this service is the responsibility of the recruiters, etc. Therefore, we do not guarantee the truthfulness, legality, safety, appropriateness, usefulness, up-to-dateness, or any other matters related to the information provided. Users shall use this service at their own risk.
2. The Company makes no guarantee that the use of this service by users will be effective in ensuring success in job seeking, career change, or career advancement.

Article 8 (Compensation for Damages)

When a user violates these Terms of Use and causes damage to the Company, the user shall be liable to compensate the Company for all damages, whether direct or indirect.

Article 9 (Handling of Personal Information)

The handling of personal information is separately stipulated in the "Personal Information Protection Policy". Based on these policies, we appropriately collect, use, manage, and store users' personal information, or provide such information to third parties.

Article 10 (Modification of Terms and Conditions)

The Company reserves the right to change these Terms of Use as necessary. Any changes to these Terms of Use shall be posted on the Internet, and all users shall be deemed to have accepted the changes after one month has elapsed.

Article 11 (Matters to be discussed)

In the event of any ambiguity in the interpretation of these Terms of Use or any matter not stipulated herein, the Company and the user shall resolve such ambiguity through good-faith consultation.

Article 12 (Governing Law and Jurisdiction)

These Terms of Use shall be governed by the laws of Japan, and any and all disputes arising out of or in connection with the Service or these Terms of Use shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
